One advantage of doing surrogacy in Cancun is that its exit process is relatively quick if you are okay with leaving your surrogate’s name on the birth certificate. For many US citizens, leaving the surrogate’s name on their baby’s birth certificate is a viable choice if the intended father is on the birth certificate and is genetically related to the child. Even with the surrogate on the birth certificate, the intended father is able to pass his US citizenship to his child and and have the CRBA issued to his child. If you are a US citizen who doesn’t plan to amend the birth certificate, you can go to the US embassy in Merida, located just 30 minutes from downtown Cancun, and apply for CRBA and US passport for your newborn. The exit process without going through Amparo (a court action to amend the birth certificate) in Cancun may be somewhat faster than other places such as Mexico City.

It is also possible to do Amparo in Cancun, but it’s not clear how long it takes.

Also, unlike the state of Sinaloa, where surrogacy is regulated, and Mexico City, there is no mechanism for obtaining a court order that says the intended parents should be on the birth certificate before the birth of the child. This is not exactly a “pre birth order”, but it is possible in Sinaloa and Mexico City. Upon obtaining this court order, intended parents can get a birth certificate with their names on it (and not the surrogate’s) upon the birth of the child. Because they don’t have to do Amparo, their exit process does not take months.
