Advantage of Surrogacy in Cancun
Several well-known surrogacy agencies have offices in Cancun. They include Miracle Surrogacy, Egg Donor Miracles, New Life Mexico, and Advanced Fertility Center in Cancun. Advanced Fertility Center in Cancun is a fertility clinic with its own in-house agency. These agencies offer different programs so intended parents have many choices to find their ideal program.
One advantage of doing surrogacy in Cancun is that its exit process is relatively quick if you are okay with leaving your surrogate’s name on the birth certificate. For many US citizens, leaving the surrogate’s name on their baby’s birth certificate is a viable choice if the intended father is on the birth certificate and is genetically related to the child. Even with the surrogate on the birth certificate, the intended father is able to pass his US citizenship to his child and and have the CRBA issued to his child. There may be exceptions; for detailed analysis, refer to the guide to exit process for American intended parents. If you are a US citizen who plans to get a default birth certificate from the local Civil Registry (remember that Civil Registry usually issues a birth certificate with the intended father and surrogate mother), you can go to the US embassy in Merida, located just 30 minutes from downtown Cancun, and apply for CRBA and US passport for your newborn. The exit process without going through Amparo (a court action to order the Civil Registry to issue a birth certificate without the surrogate’s name) in Cancun may be somewhat faster than other places such as Mexico City.
Staying in Cancun as an intended parent offers a host of advantages that make the surrogacy journey enjoyable. The city’s world-class hospitality industry ensures that there are numerous luxurious accommodations, ranging from beachfront resorts to boutique hotels, catering to every need and preference. Cancun’s warm, tropical climate provides a pleasant atmosphere year-round, perfect for relaxation and rejuvenation. The city’s rich cultural heritage and vibrant local scene offer plenty of opportunities for exploration and leisure, from visiting ancient Mayan ruins to enjoying exquisite dining experiences. Additionally, Cancun is safer than other major cities for surrogacy such as Mexico City, Guadalajara, and Culiacán in Sinaloa.
Potential Disadvantages of Surrogacy in Cancun
If you have to obtain a birth certificate with only your name(s) on it after the birth of your child through Amparo trial, Cancun might have fewer agencies that are willing to help you with that. Many agencies don’t do Amparo in Cancun, and some intended parents who have their baby born in Cancun fly to Mexico City to do Amparo. Also, many surrogacy lawyers who work in Mexico City also work in Cancun, so they can still help you obtain a favorable ruling in an Amparo trial should you decide to do it in Cancun.
Check out the following exit guides to see if you have to go through an Amparo trial following your child’s birth.

Also, unlike the state of Sinaloa, where surrogacy is regulated, and Mexico City, there is no mechanism for obtaining a court order that says the intended parents should be on the birth certificate before the birth of the child. This is not exactly a “pre birth order”, but it is possible in Sinaloa and Mexico City. Upon obtaining this court order, intended parents can get a birth certificate with their names on it (and not the surrogate’s) upon the birth of the child. Because they don’t have to do Amparo, their exit process does not take months.
